Pursuing Compensation for Victims of Animal Attack in the Bronx
New York Consolidated Laws, Agriculture & Markets Article 7, Section 123 holds owners or lawful custodians of a “dangerous dog” strictly liable for medical costs resulting from injury caused to a person, companion animal, farm animal or domestic animal. A person who is injured by a dog may be entitled to collect medical expenses, lost earnings, and other damages resulting from a dog bite injury.
Dog bites can be severe, causing permanent disfigurement. Unfortunately, some dog owners fail to properly train or care for their dogs resulting in injury to others. If a dog owner, through “any act or omission, negligently permits his or her dog to bite a person causing physical injury,” they may be held liable. If the dog was previously deemed a “dangerous dog,” they will be held strictly liable under New York law and could face criminal penalties.
