Bringing a Wrongful Death Lawsuit

According to the New York Consolidated Laws, Estates, Powers and Trusts Law Section 5-4.1, a personal representative of a decedent’s estate may bring an action for a wrongful act, neglect or default causing death. The action must be brought within two (2) years of the decedent’s death. If there is a criminal action against the defendant who allegedly caused the death, then the personal representative has at least one (1) year from the termination of the criminal action.

Recovery in a Wrongful Death Action

The New York Consolidated Laws, Estates, Powers and Trusts Law Section 5-4.3 allows a person to receive “fair and just compensation for the pecuniary injuries resulting from the decedent’s death.” This includes:

• Medical expenses
• Funeral expenses
• Lost wages and benefits
• Loss of support

In some circumstances, a personal representative may be able to bring a suit for punitive damages “if such damages would have been recoverable had the decedent survived.”
